Article 1: Purpose and scope
In accordance with Articles L.6352-3, L.6352-4 and R.6352-1 to R.6352-15 of the French Labour Code, these rules set out the main health, safety and disciplinary measures applicable to MYSTORY trainees. Every trainee shall comply with their terms throughout the training. Where the training takes place in a company that has its own internal rules, the health and safety measures applicable are those of that company.
Article 2: Equal treatment, freedom of expression and conscience, neutrality
MYSTORY ensures equal treatment of all trainees. It ensures respect for their freedom of expression and conscience, and the neutrality of the teaching provided (Article L.6352-4 of the French Labour Code). Any breach of these principles may be reported to the MYSTORY office, secretariat@mystoryformation.fr, 06 81 43 16 54.
Article 3: Health and safety
Each trainee shall comply with the general and specific health and safety instructions, failing which sanctions may be imposed. Cleanliness of the premises: trainees keep the premises tidy and clean; eating on the premises is prohibited. Alcohol and drugs: bringing in or consuming narcotics or alcoholic beverages is strictly prohibited; it is prohibited to enter or remain on the premises while intoxicated or under the influence of narcotics. Fire safety: the fire instructions and the plan showing the location of fire extinguishers and emergency exits are displayed; trainees shall carry out any evacuation order without delay. Accidents: any accident shall be reported to the training provider immediately; in accordance with Article R.6342-3 of the French Labour Code, an accident occurring during the training or on the journey to or from it is declared by the training provider to the social security fund. Smoking and vaping are prohibited on the premises; breaks allow trainees to do so outside the building.
Article 4: Hours, absences and lateness
Hours are communicated in advance and must be respected. Unless expressly authorised, trainees shall not leave during training hours and shall sign the attendance sheet for each half-day. Any absence or lateness shall be reported and justified as soon as possible (supporting document within 48 hours); the employer is informed where applicable. For training funded by a third party (Caisse des Dépôts, OPCO, France Travail), hours not attended are not covered; they do not give rise to any amount payable by the trainee.
Article 5: Conduct
Trainees shall behave in a manner that respects the rules of courtesy and community life, so that the training runs smoothly. In particular, it is prohibited to modify, use for other purposes or distribute the training materials without express authorisation, to change computer settings, or to use one’s mobile phone for purposes unrelated to the training. In accordance with Articles L.1152-1 and L.1153-1 of the French Labour Code, no trainee shall be subjected to moral or sexual harassment or to sexist conduct; any such act shall be reported to the contact person and may lead to a sanction.
Article 6: Access to the premises
Trainees may access the premises solely to attend the training for which they are registered; they may not be accompanied by persons who are not registered, unless authorised.
Article 7: Use of equipment
Trainees shall keep the equipment and documentation made available to them in good condition; using them for personal purposes is prohibited. Trainees shall not share their extranet login details. At the end of the course, they return all equipment and documents belonging to the training provider (except for the teaching materials handed out). The teaching documentation is protected by copyright and reserved for strictly personal use. Unless expressly authorised, trainees may neither record nor film the training sessions.
Article 8: No recording of sessions
Training sessions are neither filmed nor recorded by the training provider. Any recording would require the prior consent of each person present.
Article 9: Theft of or damage to personal belongings
Personal belongings brought onto the premises remain the responsibility of their owner. MYSTORY is only liable for loss, theft or damage if it is at fault.
Article 10: Sanctions
Any misconduct may, depending on its seriousness and in no particular order, lead to: a reminder of the rules, a written warning, a reprimand, temporary exclusion or permanent exclusion from the training. No financial penalty may be imposed. An exclusion does not entail any additional amount: only the sessions attended remain payable. Where applicable, the training provider informs the trainee’s employer and the body funding the training of the sanction.
Article 11: Disciplinary procedure
Pursuant to Article R.6352-4 of the French Labour Code, no sanction may be imposed unless the trainee has first been informed of the complaints against them. The training provider summons the trainee by registered letter with acknowledgement of receipt or by letter delivered by hand against a receipt, stating the purpose, date, time and place of the interview (unless the sanction has no effect on the rest of the training). At the interview, the trainee may be assisted by a person of their choice and gives their explanation. The sanction, which must state its reasons, is notified in writing no sooner than one clear day and no later than fifteen days after the interview; the employer and, where applicable, the funding body are informed at the same time. A precautionary measure of temporary exclusion with immediate effect may be taken in compliance with the rights of the defence.
Article 12: Trainee representation
For courses lasting more than 500 hours, a full delegate and a substitute delegate are elected (Article R.6352-9 et seq. of the French Labour Code); the vote takes place during training hours, between the 20th and the 40th hour. If no delegate can be elected, a report of non-election is drawn up and sent to the regional prefect. The delegates present individual or collective complaints relating to the conduct of the training, health, safety and the application of these rules. As the training courses delivered by MYSTORY last less than 500 hours, no election of delegates is required; trainees send their requests directly to the MYSTORY office (secretariat@mystoryformation.fr) and their complaints as set out in Article 13.
Article 13: Disability contact person and complaints
Disability contact person: Arudhan NATKUNASINGAM, arudhan@mystoryformation.fr, 06 81 43 16 54. Any adjustment is considered; the premises are accessible to people with reduced mobility. Any complaint shall be sent in writing to contact@mystoryformation.fr (acknowledgement within 48 hours, reply within 15 working days).
Article 14: Publication
These rules are displayed on the premises and on the training provider’s website; a copy is given to each trainee before final registration.
